Inthefieldofcrimination,itisahighlydebatableissuethatwhetherthecircumstancesofanindividualcrimeandthemotivationshouldtakeintoconsideration.Somepeopleadvocatethatfixedpunishmentsforeachtypepfcrimearenecessarytoupholdjustice.Howeverinmyopinion,itisarbitrarytocriminatesomeonewithoutathoughtofthecriminalmotive.
Firstly,fixedpunishmentdohaveadeterringeffectonsociety.Ifthecriminalsknowtheywillbesubjecttoacertainpunishment,theywillreconsidercommittingthecrime.Thisdeterringeffecthelptobuildsocialstabilityandsafetythroughdeclinethrateofcrime.
Secondly,sincepunishmentswerefixed,thosecriminalswouldnotbeabletoconvincethecourtforunguilt.Thiswouldstopthecunningcrimialsfromescapetheirpunishments.
But,letusthinkitover.Canapersonkillinginself-defensecomparedtoaheartlessmuder?Canapersonsteallingtofeedhisstarvingchildrencomparedtoarobberwithdrugaddiction?Theanswersareobviouseventheydidthesamecrime.Thus,ifwedonottakethecircumstancesofanindividualcrimeandthemotivationintoaccount,thelawswillbenothingbutcold-hearted.
Inmyopinion,anintermediarypositionbetweenbothsolutionsistheperfectwaytoensurejusticeandequity.Wewouldnotletapersonwithgulitescapeandwouldnotpunishevenasingleinnocence.Sincetherestilllotsofspaceforthelawstodevelop,ourgovernmentshouldthinkmoreabouthumanrightsandgivethosewhocrimewithoutintentionachancetoturntoanewleaf.
